Welcome to StayOvah
These Terms and Conditions govern your use of StayOvah and the services provided through our platform. By accessing or using StayOvah, you agree to be bound by these Terms.
1. Definitions
- "Platform" refers to the StayOvah website and mobile applications.
- "Host" refers to users who list properties for rent.
- "Guest" refers to users who book properties.
- "Listing" refers to a property advertised on the Platform.
- "Booking" refers to a reservation made through the Platform.
2. Eligibility
To use StayOvah, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete registration information
- Maintain the security of your account credentials
3. Host Obligations
As a Host, you agree to:
- Provide accurate descriptions and photos of your property
- Ensure your property meets all applicable safety and legal requirements
- Honor confirmed bookings unless exceptional circumstances arise
- Maintain your property in the condition represented in your Listing
- Respond promptly to guest inquiries and booking requests
4. Guest Obligations
As a Guest, you agree to:
- Treat the property with respect and care
- Comply with all House Rules set by the Host
- Leave the property in a similar condition to how you found it
- Be responsible for any damage caused during your stay
- Accurately represent the number of guests
5. Payments and Fees
Service Fees: StayOvah charges a service fee on each booking. This fee covers platform maintenance, customer support, and payment processing.
Payment Processing: All payments are processed securely through our payment partners. StayOvah does not store your full payment card details.
Cancellation Fees: Cancellation policies are set by individual Hosts. Review the cancellation policy before booking.
6. Cancellations and Refunds
Cancellation and refund policies are determined by the Host for each Listing. Guests should review the applicable policy before booking. StayOvah may issue refunds in cases of Host cancellations or extenuating circumstances as determined at our discretion.
7. User Conduct
You agree not to:
- Violate any laws or regulations
- Infringe on the rights of others
- Post false, misleading, or fraudulent content
- Harass, abuse, or harm other users
- Attempt to circumvent platform fees
- Use the Platform for unauthorized commercial purposes
8. Intellectual Property
All content on the StayOvah platform, including logos, designs, text, graphics, and software, is the property of StayOvah or its licensors and is protected by copyright and other intellectual property laws.
9. Limitation of Liability
StayOvah acts as a platform connecting Hosts and Guests. We are not responsible for the conduct of users or the condition of properties. To the maximum extent permitted by law, StayOvah shall not be liable for any indirect, incidental, special, or consequential damages.
10. Dispute Resolution
If a dispute arises between users, StayOvah may attempt to facilitate a resolution but is not obligated to do so. Users are encouraged to resolve disputes amicably. For disputes with StayOvah, you agree to first attempt to resolve the matter through good-faith negotiations.
11. Modifications to Terms
StayOvah reserves the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
12. Account Termination
StayOvah may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or other conduct that we determine to be harmful to the Platform or other users. You may also terminate your account at any time through your account settings.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
